Luxia
These Terms of Service (“Terms”) govern your use of the Luxia mobile application (“App,” “we,” “us,” or “our”). By downloading, installing, or using Luxia, you agree to these Terms. If you do not agree, do not use the App.
Luxia is a radio streaming application that lets you discover and listen to internet radio stations from around the world. Station listings and stream metadata are provided through third-party sources (including the Radio Browser community API). Luxia is not affiliated with, endorsed by, or sponsored by any particular radio broadcaster unless expressly stated.
You must be able to form a binding contract under the laws of your jurisdiction to use Luxia. If you are under the age of digital consent in your country, you may use the App only with the involvement of a parent or legal guardian.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Luxia on Apple devices that you own or control, solely for personal, non-commercial listening, in accordance with the Apple Media Services Terms and the App Store Terms of Use.
You may not:
Luxia aggregates links to publicly available internet radio streams. We do not own, control, or produce the audio content broadcast by those stations. Station availability, quality, legality, and content are the responsibility of the respective broadcasters and stream hosts.
Streams may contain advertisements, news, music, talk, or other material. Content may change without notice and may not be suitable for all audiences. If you believe a stream infringes your rights, contact the station operator and notify us at haxcorporation@gmail.com so we can review removal of the listing from the App where appropriate.
Custom station URLs that you import are provided by you. You are solely responsible for ensuring you have the right to access and play those streams.
Luxia offers optional premium features through in-app subscriptions (for example, “Luxia Pro”), which may include features such as the world radio map, favorites, sleep timer, moment clips, custom station import, and advanced analytics. Feature availability may change over time.
Payments are processed by Apple via the App Store. Subscription terms, pricing, renewal, cancellation, and refunds are governed by Apple’s policies. Manage or cancel subscriptions in your Apple ID settings (Settings → Apple ID → Subscriptions).
The free version of Luxia may display advertisements provided by third-party ad networks (such as Google AdMob). Ad partners may collect certain device or usage information as described in our Privacy Policy and in the partners’ own policies.
Optional features such as “Near Me” may use your device location to find nearby stations. Location access is requested only after an in-app explanation, and you may deny or later revoke permission in iOS Settings. Denying location access does not prevent you from using the rest of the App.
Pro features may allow short personal clips captured from a temporary replay buffer for your own private use (for example, bookmarking a moment). Clips are not a substitute for licensed recording or redistribution of broadcast content. You may not use clips to publicly redistribute copyrighted material without appropriate rights.
Luxia, including its software, design, logos, and branding, is owned by us or our licensors and is protected by intellectual property laws. Station names, logos, and broadcast content remain the property of their respective owners. THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT STREAMS WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE IN YOUR REGION, OR THAT STATION METADATA WILL BE ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR ANY THIRD-PARTY STREAM. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE U.S. DOLLAR IF YOU HAVE NOT PAID.
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted by law.
You agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the App, your imported stream URLs, or your violation of these Terms or applicable law.
We may suspend or terminate access to the App (or specific features) if you violate these Terms or if we discontinue the service. You may stop using the App at any time and delete it from your device. Provisions that by nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree, stop using the App.
You acknowledge that these Terms are between you and the Luxia developer only, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. To the extent any warranty exists that cannot be disclaimed, Apple’s sole obligation is a refund of the App purchase price (if any). Apple is not responsible for addressing claims relating to the App or your possession/use of it, including product liability, legal/regulatory claims, or consumer protection claims. Apple is a third-party beneficiary of these Terms and may enforce them against you.
These Terms are governed by the laws applicable in your place of residence and in the jurisdiction where the developer operates, without regard to conflict-of-law principles, except where mandatory consumer protection laws require otherwise.
